HIPAA Privacy Rule Notice

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION.  PLEASE REVIEW IT CAREFULLY.

THE EFFECTIVE DATE OF THIS NOTICE IS APRIL 14, 2003. Corporate Health Resources, Inc. (CHR) will follow the terms of this notice until it is replaced or modified and you have been notified of those changes.

CHR is committed to maintaining your employee medical record and medical information in a manner to ensure you the highest level of privacy and confidentiality. Access to employee health records is carefully controlled and restricted. When authorized, only the minimum level of health information necessary to accomplish the intended purpose is released and then only to those individuals who have a specific need-to-know. We have always taken privacy and confidentially seriously and this notice, required by law, gives you information about the duties and privacy practices of CHR.

Uses and Disclosures of Your Health Information

CHR obtains files, discloses and uses your health information for a variety of purposes including but not limited to:

  • Medical case management
  • Return-to-work assessment
  • Medical surveillance
  • Independent medical evaluation
  • Fitness for duty evaluation
  • Functional capacity evaluation
  • Preplacement examinations
  • Periodic examinations
  • Wellness health evaluations
  • International travel examinations

CHR will not obtain, disclose and use your health information that contains personally identifiable data without your knowledge and written permission to do so. Even with your written permission, CHR will disclose only the minimum amount of health information necessary to accomplish the intended purpose. If you give CHR your written release of medical information, you may revoke that release in writing at any time.

Certain health information may be released without your knowledge or approval. This includes release of medical information as required by law or at the request of an official of the U. S. Department of Health and Human Services, in response to subpoena or valid legal proceedings request, when medical information is required to determine work-relatedness of injuries or illnesses, in adjudication of Workers’ Compensation claims, when necessary to prevent a serious threat to your health or the health and safety of others, and in emergency situations when it is impractical or impossible to obtain a written release.

Medical information that contains no personally identifiable information may be used in aggregate to assess program effectiveness. This group-based medical information is prepared and presented in such a manner that the results or conclusions cannot be attributed to any individual and cannot be used for any employment actions.

Your Rights

Your employee health record is stored and maintained by CHR or a location designated by your employer. You have access to your employee health records in accordance with your company’s medical records policy. You have certain rights under law pertaining to the health information obtained, disclosed and used by CHR. You may make a written request of CHR to:

  • Receive a paper copy of this notice for your personal records
  • Review and get copies of your employee health record
  • Amend or correct your employee health record
  • Receive a list of the disclosures of your health information
  • Place restrictions on the use and disclosure of your health information
  • Receive confidential communications pertaining to your health information

These rights may be subject by law to certain limitations and restrictions.

Corporate Health Resources’ Duties

CHR is required by law to maintain the privacy of your health information contained in your Employee Health Record and to assist you in the execution of your rights as noted above. We have established and published standards and policies for handling employee medical records, developed electronic and physical safeguards to protect your personal health information and trained those individuals who may have access to personally identifiable health information. The law allows CHR to change the terms of this notice at any time following notification to all covered individuals.

Complaints

If you believe your privacy rights have been violated by CHR, you have right to complain to the Secretary of the Department of Health and Human Services.
